Please read these terms carefully before using TRAKITO products and services.

1. Company Information

These Terms and Conditions ("Terms") govern your access to and use of the Trakito mobile application, web platform, and related services (collectively, the "Service") provided by GPScom Technologies ("Company", "we", "our", or "us").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Description of Service

Trakito is a GPS tracking and asset management platform that allows users to:

  • Track the real-time location of GPS devices
  • View historical routes and movement data
  • Receive alerts and notifications
  • Manage devices, SIM subscriptions, and geofences
  • Monitor assets such as vehicles, motorcycles, persons, and equipment

The Service requires compatible Trakito GPS devices and active connectivity.

3. User Account

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete information
  • Keep your login credentials secure
  • Be responsible for all activity under your account
  • Notify us immediately of unauthorized access

You are fully responsible for your account and devices.

4. Device and SIM Activation

Trakito devices may include integrated SIM connectivity and subscription services. Activation may occur:

  • Automatically upon first use
  • Upon registration in the Trakito platform

Subscription periods, if included, are defined at the time of purchase. After the subscription period ends, continued use may require renewal.

5. Acceptable Use

You agree NOT to use the Service:

  • For illegal purposes
  • To track individuals without their consent where required by law
  • To violate privacy or data protection laws
  • To interfere with the Service or servers
  • To attempt unauthorized access to systems or accounts

You are solely responsible for lawful use.

6. Location Accuracy Disclaimer

Location data accuracy may be affected by:

  • GPS signal conditions
  • Indoor environments
  • Network availability
  • Device battery level
  • Hardware limitations

We do not guarantee continuous or 100% accurate location tracking. The Service is provided for informational purposes only.

7. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted operation. The Service may be affected by:

  • Mobile network operators
  • Internet connectivity
  • Server maintenance
  • Third-party services
  • Force majeure events

We may modify, suspend, or discontinue parts of the Service at any time.

8. Subscription and Payments

Some features require an active subscription. Subscriptions may include:

  • Included period with device purchase
  • Monthly or yearly renewal plans

Failure to renew may result in limited functionality or suspension. All payments are non-refundable unless required by law.

9. Data and Privacy

We collect and process data necessary to provide the Service, including device location data, account information, device identifiers, and usage data.

All data is handled in accordance with our Privacy Policy and applicable data protection laws (including GDPR). You are responsible for using tracking features in compliance with privacy laws.

10. Ownership and Intellectual Property

All rights to the Trakito Service, including software, platform, logos, branding, and content are owned by GPScom Technologies. You may not copy, modify, reverse engineer, or redistribute the Service.

11. Limitation of Liability

To the maximum extent permitted by law, GPScom Technologies shall not be liable for loss of property, theft, damage, business interruption, loss of data, or indirect or consequential damages. The Service is provided "as is" without warranties. Use is at your own risk.

12. User Responsibility

You are responsible for:

  • Proper installation of devices
  • Keeping devices charged
  • Maintaining active subscription
  • Using the Service legally

The Company is not responsible for misuse or improper installation.

13. Termination

We may suspend or terminate accounts that violate these Terms, abuse the Service, or engage in illegal activity. You may stop using the Service at any time.

14. Updates to Terms

We may update these Terms periodically. Continued use of the Service means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of Greece and the European Union. Any disputes shall be subject to the jurisdiction of courts in Thessaloniki, Greece.

End-User License Agreement

This agreement governs your use of the Trakito mobile application.

1. Application Provider

Apple and Google are not responsible for the App or its content.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Install and use the Trakito App on devices you own or control
  • Access and use the Trakito platform for personal or business use
  • Monitor GPS tracking devices connected to your account

You may not copy, redistribute, reverse engineer, modify, or create derivative works of the App, or use it for illegal purposes.

3. Account & Device Services

You must create an account to use the App. You agree to provide accurate information, maintain confidentiality of login credentials, and be responsible for all activities under your account. The App is used with compatible Trakito GPS tracking devices. Some features require active device subscription, internet connectivity, and mobile network coverage.

4. Location Services & Permissions

The App may request access to location services, notifications, camera (for QR code scanning), and internet connectivity. Location data is used solely to provide tracking functionality. You can manage permissions in your device settings.

5. User Responsibilities & Legal Compliance

You agree to use the App only in compliance with applicable laws. You are solely responsible for ensuring legal use of tracking devices, obtaining consent where required, and complying with privacy and surveillance laws. The Company is not responsible for unlawful use.

6. Privacy, Data & Liability

All data collected is handled in accordance with our Privacy Policy and GDPR regulations. GPScom Technologies shall not be liable for loss of property, theft, tracking inaccuracies, loss of data, or indirect or consequential damages. The App is provided "AS IS" without warranties.

7. App Store Terms

Apple App Store: Apple is not responsible for maintenance, support, or claims related to the App. Apple and its subsidiaries are third-party beneficiaries of this Agreement.

Google Play: Google is not responsible for the App or its functionality, and has no obligation to provide maintenance or support.

8. Updates, Termination & IP

We may release updates to improve functionality, security, or compatibility. We may suspend or terminate access if you violate this Agreement, misuse the App, or engage in illegal activities. The App and all related content are owned by GPScom Technologies. All rights are reserved. Trakito™ is a trademark of GPScom Technologies.

9. Governing Law & Contact

This Agreement is governed by the laws of Greece and the European Union. Disputes shall be resolved in the courts of Thessaloniki, Greece.
